Many people do not understand the full ramifications of a possessing controlled substances, such as cocaine, meth, or MDMA (a.k.a. Ecstasy) in Texas. These drugs are classified by the Texas Health and Safety Code as belonging in Penalty Group 1 (PG1), and unlike Possession of Marijuana under 2 ounces is a misdemeanor, possession of PG1 substances is a felony. Also, the list of illegal drugs covered by this section of the Code is vast.

Moreover, unlike Marijuana where a usable amount must be possessed, all the Brazos County District Attorney needs to move forward with the case is to show that the Defendant possessed any amount of the PG1 drug. For example, what is often referred to as a "trace case," which means that only a very small amount of residue was discovered, is enough to support a felony criminal prosecution and conviction.

The felony classification for Possession of a Controlled Substance in the PG1 group depends on several factors with the weight of the drug being the main factor in most criminal cases.
